When tips fall short
If a worker's cash wage plus reported tips do not average to the Maryland minimum of $15.00 per hour over a workweek, the employer must pay the shortfall. Under the 2021 DOL final rule, time spent on non-tip-producing work above 20 percent of the shift (or 30 continuous minutes) must be paid at the full minimum, not the tip-credited rate. [DOL FS-15]

Warning: The Maryland wage-facts page also lists county ordinance increases effective 1 July 2026 (Howard, Montgomery, Prince George's). Those are county rates, not the state minimum, and must not be read as a state increase. Md. Code Lab. and Empl. 3-413 ends at $15.00 from 1 January 2024 for employers of every size, with no indexing clause.
